Gabi Terms and Conditions of Use

1. Acceptance

These Terms and Conditions govern access to and use of Gabi, a platform operated by ASPIS Consulting Colombia S.A.S., hereinafter “ASPIS”.

By accessing, registering, submitting information, applying for a position, or communicating with Gabi through the website, WhatsApp, email, or another enabled channel, the user acknowledges having read and accepted these Terms and the Privacy Policy.

Anyone using Gabi on behalf of a company represents that they have sufficient authority to act on its behalf.

2. Service description

Gabi is a human resources and recruitment platform that may, among other features, allow users to:

• Publish and browse job openings.
• Receive applications and résumés.
• Contact candidates.
• Manage recruitment processes.
• Schedule interviews and assessments.
• Receive documents and authorizations.
• Send reminders and communications.
• Facilitate hiring and workforce-management processes.
• Use automation, information extraction, and artificial intelligence as support tools.

Gabi does not guarantee that a candidate will be hired, selected for a position, or that a job opening will remain available.

Each client company is responsible for its job openings, requirements, and employment decisions.

3. User requirements

The user represents that:

• The information provided is true, complete, and up to date.
• They have the legal capacity to accept these Terms.
• They are authorized to provide third-party information, such as personal references or beneficiary information.
• They will not use Gabi for fraudulent or illegal activities or to infringe third-party rights.
• They will not impersonate others or submit false documents.

Ordinary use of the platform is intended for adults. Minors’ data will be processed only where there is a valid legal basis and their prevailing rights are respected.

4. Use of WhatsApp

When users provide their phone number, start a conversation, reply to a message, or expressly authorize this channel, they agree to receive Gabi communications concerning:

• Job openings and applications.
• Confirmation of interest.
• Interviews and assessments.
• Requests for or receipt of documents.
• Pre-employment authorizations.
• Process reminders and updates.
• Support and security.
• Other communications needed to provide the requested service.

Communications may be sent through the WhatsApp Business Platform, operated by Meta, and through other technology providers authorized by ASPIS.

Users may request that non-essential communications stop by replying “STOP”, “UNSUBSCRIBE”, or “I DO NOT WANT TO RECEIVE MESSAGES”, or by contacting ASPIS at [email protected].

An opt-out request does not prevent strictly necessary communications from being sent to complete an active request, answer an inquiry, meet a legal obligation, or protect account security.

Users are also subject to the applicable WhatsApp and Meta terms and policies.

5. Responsibilities of companies and recruiters

Companies and individuals using Gabi to manage recruitment processes agree to:

• Publish accurate information about job openings.
• Process candidate data lawfully and confidentially.
• Have the required authorizations or legal bases.
• Not request excessive or unnecessary data.
• Not discriminate on grounds prohibited by law.
• Restrict access to authorized personnel.
• Conduct human review of automated recommendations or results.
• Not sell or reuse résumés for incompatible purposes.
• Address applicable inquiries, corrections, and deletion requests.
• Comply with applicable employment and data-protection laws.

6. Documents and user-provided content

Users retain any rights they hold in the documents, messages, images, résumés, and other content they provide.

Users grant ASPIS a limited authorization, for the time required, to store, process, convert, analyze, back up, and communicate this information to authorized recipients for the purpose of providing Gabi’s services.

Users warrant that they have the right to provide this content and that it does not infringe third-party rights.

ASPIS may block or remove content that is fraudulent, illegal, malicious, or contrary to these Terms.

7. Artificial intelligence and automation

Gabi may use artificial intelligence, optical character recognition, and automated processing tools to:

• Read and structure résumés.
• Extract information from documents.
• Generate questions.
• Summarize interviews or responses.
• Classify information.
• Suggest scores or matches between profiles and job openings.

These tools may produce incomplete or incorrect results and do not replace human review.

Hiring, rejection, disciplinary, or employment-termination decisions must not be based exclusively on automated results. The company responsible for the process makes the final decision.

8. Privacy and data processing

Personal data is processed in accordance with the ASPIS Privacy and Personal Data Processing Policy.

Depending on the service, ASPIS may act as a data controller or as a processor for a client company.

Data may be processed by providers required to operate Gabi, including hosting, storage, authentication, email, WhatsApp, artificial intelligence, OCR, and calendar services.

Some providers may process information outside Colombia. ASPIS will apply the appropriate contractual and security measures.

ASPIS does not sell its users’ personal data.

9. Personal data rights

Data subjects may request:

• Access to their data.
• Updates or corrections.
• Information about how their data has been used.
• Proof of authorization, where applicable.
• Revocation of authorization.
• Deletion of their data, where legally permitted.
• Suspension of commercial communications.

The request must state the data subject’s name and contact information, clearly describe the request, and include the information needed to verify their identity.

Deletion may be restricted when legal, contractual, accounting, judicial, or security obligations require certain information to be retained.

10. Intellectual property

Gabi, its software, interfaces, designs, trademarks, documentation, and components belong to ASPIS or its licensors.

Access to the platform does not transfer intellectual property rights. Users receive only a limited, revocable, non-exclusive, and non-transferable authorization to use the service.

Users must not:

• Copy, sell, or sublicense Gabi.
• Attempt unauthorized access.
• Reverse engineer the service, except where expressly permitted by law.
• Introduce malware or harmful code.
• Extract information in bulk.
• Circumvent security controls.
• Use data to create unauthorized commercial databases.
• Impersonate individuals or companies.

11. Third-party services

Gabi may rely on services provided by third parties, including Meta and WhatsApp.

These services operate under their own terms, availability, and policies. ASPIS does not control interruptions, restrictions, or changes made directly by those providers.

Integration with an external provider does not mean that the provider sponsors, endorses, or is responsible for Gabi.

12. Availability and suspension

ASPIS will use reasonable efforts to keep the platform available and secure but does not guarantee uninterrupted or error-free operation.

Access may be suspended due to:

• Maintenance.
• Security risks.
• Fraudulent or illegal use.
• Breach of these Terms.
• A request from a competent authority.
• Failures of external providers.
• Force majeure.
• Non-payment, where applicable.

13. Limitation of liability

ASPIS does not guarantee that a candidate will be hired or that a company will find the personnel it requires.

Each company is responsible for its job openings, instructions, and employment decisions. Each user is responsible for the truthfulness and legality of the information they provide.

To the fullest extent permitted by law, ASPIS will not be liable for damages arising from:

• False information provided by users.
• Decisions made by client companies.
• Use contrary to these Terms.
• Interruptions attributable to third parties.
• Automated results used without human review.
• Unforeseeable events or force majeure.

These limitations do not apply where liability cannot legally be excluded.

14. Termination

Users may stop using Gabi and request account closure or deletion of information where applicable.

ASPIS may suspend or terminate access in cases of material breach, fraud, security risk, or illegal use.

After termination, information will be deleted, anonymized, or retained in accordance with applicable legal, contractual, and security obligations.

15. Amendments

ASPIS may update these Terms due to legal, technical, or operational changes.

The current version and its revision date will be available on this page. Material changes will be communicated through a reasonable channel, and renewed acceptance will be requested where appropriate.

16. Governing law and disputes

These Terms are governed by the laws of the Republic of Colombia.

The parties will first seek to resolve any dispute directly. If no solution is reached, they may refer the matter to the competent administrative or judicial authorities.

Nothing in these Terms limits consumers’ non-waivable rights or the authority of Colombia’s Superintendence of Industry and Commerce.
